PROVISIONS GENERAL
These general terms and conditions of sale (hereinafter, the “GENERAL TERMS AND CONDITIONS”) are provided by Oleificio Corazza S.n.c. to its customers in the interests of transparency and completeness, and apply to all sales of products purchased via this website. Oleificio Corazza S.n.c. may occasionally need to amend certain provisions of the General Terms and Conditions; we therefore invite customers to consult them before each visit to the website. Confirmation of an order implies tacit acknowledgement and acceptance of the General Terms and Conditions in force at that time.
In accordance with the provisions of Italian and EU legislation currently in force, the commercial relationship between the seller and the customer is governed by consumer protection legislation only where the customer makes a purchase for personal purposes unrelated to their professional activity. Consequently, consumer protection legislation – including, in particular, Legislative Decree No. 185 of 1999 (distance contracts), Legislative Decree No. 50 of 1992 (right of withdrawal) and Articles 1469-bis et seq. of the Italian Civil Code.
Contracts concluded with Oleificio Corazza S.n.c. via the website are governed by Italian law and, in particular, by Legislative Decree No. 206 of 6 September 2005 (hereinafter the ‘CONSUMER CODE’) and by Legislative Decree No. 70 of 9 April 2003 (hereinafter the “E-COMMERCE DECREE”).

PRICES AND PAYMENTS
The price of the products is includes all of all the taxes and VAT. All prices are quoted in euros.

Customers required to request an invoice must do so at the time of ordering, providing their VAT number and tax code.

HOW TO PROCESS THE ORDERS

To purchase the Products, the Customer must complete and submit the order form electronically, following the instructions on the Website. The Customer must add the Product to the “Shopping Basket” and, after reading the General Terms and Conditions and the Privacy Policy, must enter their delivery and billing details, select their preferred payment method and confirm the order.
By confirming the order, which constitutes a contractual offer, the Customer acknowledges and declares that they have read all the information provided during the purchase process and that they fully accept these General Terms and Conditions and the payment terms set out herein.
The contract entered into with the Customer shall be deemed to have been concluded upon acceptance of the order by Oleificio Corazza S.n.c. Such acceptance is communicated to the Customer via an order confirmation email. If the Customer is a consumer (i.e. a natural person purchasing goods for purposes unrelated to their professional activity), once the online purchase process has been completed, they shall print or save an electronic copy and, in any event, retain these General Terms and Conditions of Sale, in accordance with the provisions of Italian legislation governing distance contracts.
The Customer shall have no right to claim damages or compensation, nor shall the Company be liable, whether contractually or otherwise, for any direct or indirect damage to persons and/or property caused by the non-acceptance or non-fulfilment, even partial, of an order.

DELIVERY
All purchases will be delivered by GLS courier from Monday to Friday, excluding public holidays and national holidays.
Once the goods have been dispatched, the Customer will receive a confirmation email containing a tracking number, which will include a link to track the delivery.

INDISPONIBILITA’ PRODOTTI
Qualora i prodotti ordinati risultassero temporaneamente indisponibili, l’Azienda Oleificio Corazza S.n.c provvederà ad informarne tempestivamente il Cliente, ferma restando la facoltà di quest’ultimo di rinunciare all’ordine.

RIGHT OF WITHDRAWAL

Pursuant to the combined provisions of Articles 64 et seq. of the CONSUMER CODE (Legislative Decree No. 2005/206) and the provisions of Legislative Decree No. 21 of 21 February 2014, the end consumer is entitled to withdraw from the purchase contract for any reason, without having to provide an explanation and without incurring any penalty.
This right may no longer be exercised in relation to the categories of goods and services expressly specified in Article 59 of Legislative Decree of 21 February 2014, No. 21 (by way of example, but not limited to, the following types of products sold on the WEBSITE are cited as those most likely to be subject to this exclusion: Article 59(c) – the supply of goods made to measure or clearly personalised; Article 59(d) – the supply of goods in risk of rapid deterioration or expiry; Article 59(e) the supply of sealed goods which, for reasons of hygiene or health protection, are not suitable for return and have been unsealed after delivery; Article 59(f) the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods; Article 59(g) the supply of alcoholic beverages, the price of which was agreed at the time the sales contract was concluded, the delivery of which can only take place after thirty days and the actual value of which depends on market fluctuations beyond the trader’s control).

To exercise this right, the customer must send a notice within 14 working days of the date of receipt of the goods. Once we have received the aforementioned notice of withdrawal, our customer service team will provide the customer with instructions on how to return the goods, which must be received at our warehouses within 10 days of authorisation.

The right of withdrawal is, however, subject to the following conditions:
1. The right applies to the product purchased in its entirety; it is not possible to exercise the right of withdrawal in respect of only part of the product purchased
2. In accordance with the law, the postage costs for returning the goods are to be borne by the customer
3. The customer bears full responsibility for the consignment until we have confirmed receipt at our warehouse
4. We accept no liability whatsoever for damage to, or theft or loss of, goods returned via uninsured shipments
5. In the event of damage to the goods during transit, the customer will be notified of the incident (within 5 working days of receipt of the goods at our warehouse), to enable them to lodge a claim against the courier they have chosen and obtain a refund of the value of the goods (if insured). In this event, the product will be made available to the customer for return, whilst simultaneously cancelling the withdrawal request
6. The right of withdrawal cannot be exercised in any way in respect of perishable goods with an expiry date of 10 days or less.

The customer will be refunded the full amount already paid, within 30 days of the goods being returned, either by crediting the amount charged to their credit card or by bank transfer. In the latter case, the customer is responsible for providing the bank details to which the refund is to be made.
The right of withdrawal shall lapse entirely if the essential condition of the goods’ integrity (packaging and/or contents) is not met, in cases where it is established that: a. the outer packaging and/or label of the purchased product is missing; b. the product has been damaged for reasons other than transport.
Should the right of withdrawal lapse, the purchased goods will be returned to the sender, and the sender will be charged for the postage costs. The right of withdrawal cannot be exercised by professional traders under any circumstances.
